Be it known that on the seventh day of April, 1917 the last will with a codicil which is hereunto annexed of Ada Winthrop Vesey of Devonshire Parish in the islands of Bermuda deceased, who died on the fifteenth day of March, 1917, at Devonshire Parish aforesaid was duly admitted to probate in this Court and that the Administration of the personal estate of the deceased is hereby granted by this court to Herbert Albuoy Peniston, Robert Vesey Murdoch, and Nathaniel Burton Taylor named in the said will, they having been first duly sworn as appears by their affidavit, which is hereunto annexed.
Given under my hand and the Seal of the Supreme Court this seventh day of April 1917.

In the estate of Ada Winthrop Vesey, deceased

We, Herbert Albuoy Peniston of Smith's Parish in the islands of Bermuda, farmer, Robert Vesey Murdoch of Pembroke Parish in the said Islands clerk and Nathaniel Burton Taylor of Pembroke Praish aforesaid surveyor, make oath and say that we believe the paper writings ereto annexed and marked "A" and "B" respectively and initialled by us to ___ in respectively the true and original last will and testament and a codicil thereto of Ada Winthrop Vesey late of Devonshire parish in the said Islands, deceased, who died a widow on the fifteenth day of march 1917, at Devonshire parish aforesaid; that the said Herbert Albuoy Peniston is a brother of the said deceased; that the said Robert Vesey Murdoch is a nephew of the late husband of the said deceased; that the said Nathaniel Burton is a grandson of the late husband of the said deceased; that we are the three executors named in the said will, that we will administer according to the law all the personal estate of the said deceased; that we will exhibit a true and perfect inventory of the said estate, and render a just and true account thereof whenever required by law so to do; and that the gross value of the said estate amounts to L110 or thereabouts to the best of our knowledge, information and belief.

Sworn at Hamilton, Bermuda by the said Herbert Albuoy Peniston, Robert Vesey Murdoch, and Nathaniel Burton Taylor this second day of April 1917.

This is a codicil to the last will of me Ada Winthrop Vesey of Devonshire parish in the Islands of Bermuda which will bears the date the twentieth day of March one thousand nine hundred and eleven. Whereas by the second clause of my said will I have bequeathed my personal estate to my executors upon trust to sell and to apply the net proceeds of the sale in the manner therein expressed and by the sixth clause of my said will I have empowered the trustees of my said will to sell the whole or any part of my real estate and by the seventh clause of my said will I have directed my said trustees to apply the net proceeds of any such sale in the manner therein expressed now I hereby declare that nowithstanding the foregoing provisions of my siad will my said trustees may apply the net proceeds of any sale of my personal estate or of any sale of any real estate in or towards payment of any debts owing by me or any charges on any of my real estate at the absolute discretion of my trustees and without being obliged to resort to the sale of any of my personal estate to meet such debts or charges if in the discretion of my said trustees it would be more expedient to sell a portion of my real estate for such purposes and I also declare that the name of the guardian mentioned in the ninth clause of my said will as "Robert Vesey Murdock" should be Robert Vesey Murdoch one of the trustees and executors of my said will and inall other respects I confirm my said will set my hand this twenty first day of February one thousand nine hundred and seventeen. I Ada Winthrop Vesey of Devonshire Parish in the Islands of Bermuda, widow of the late Honourable Nathaniel Vesey, lately a member of the Legislative Council of the siad Islands, do hereby revoke all wills and testamentary dispositions heretofore made by me and declare this to be my last will of which I appoint my brohter Herbert Albuoy Peniston and my late husband's nephew Robert Vesey Murdoch and grandson Nathaniel Burton Taylor to be the executors and trustees and I declare that the expression "my said trustees" hereinafter used shall mean the trustees or trustee for the time being of this my will.

2. I bequeath all my personal estate to my said executors upon trust to sell call in and convert into money such parts thereof as shall not consist of ready money and to apply the net proceeds of such sale calling in and conversion and in ready money of which I sahll die possessed in or towards payment of my debts and funeral and testamentary expenses and then to apply the residue of such moneys at the absolute discretion of my said executors in or towards the maintenance and education of my thee sons Nathaniel Henry Peniston Vesey, John Ernest Peniston Vesey, and Thomas Winthrop Peniston Vesey in such manner as my said executors shall deem expedient and on the youngest survivor of my said sons attaining the age of twenty one years I direct my executors to divide my residuary personal estate in equal shares between such of my sons as shall then be living or if only one of my said sons shall then be living I direct my executors to pay and deliver the whole of my residuary personal estate to such son absolutely.

3. It is my wish that the old household furniture plate silver china glass and other family effects which came to me through my mother shall not be sold under the provisions of the preceding clause unless my executors shall deem it necessary to sell the same for the purposes therein expressed.

4. I devise all my real estate to my said trustees their heirs and assignes upon trust to let and manage the same at their discretion or to permit my said sons or any or either of them to occupy or use the same or any part thereof until the youngest survivor of my said sons shall attain the age of twenty one years and on the happening of that event I devise the whole of my said real estate to such of my said three sons as shall then be living in equal shares as tenants in common in fee simple and if only one of my said sons shall then be living I devise the whole of my said real estate to him in fee simple.

5. I direct my said trustees to pay or apply the net rents and profits of each part of my real estate as shall from time to time be rented by them under the trust contained in the preceding clause of this my will in or towards the maintenance education and advancement in life of my said three sons or such of them as shall for the time being under the age of twenty one years at the absolute discetion of my siad trustees and in such manner and in such proportions as they may deem expedient.

6. Notwithstanding the foregoing trusts and provisions with respect to my said real estate I hereby empower my said trustees if they shall deem it expedient so to do at any time before the youngest survivor of my said sons shall attain the age of twenty one years to sell in such manner and on such terms as they shall deem advisable the whole or any part of my said real estate and for this purpose I devise my said real estate to my said trustees upon trust to sell as aforesaid with power to do so and execute all acts deed assurances and things whch may be necessary for effectuating any such sale

7. In the event of any sale of my said real estate or any part thereof under the power of sale hereinbefore contained I direct that my said trustees shall at their absolute discretion apply the net proceeds of such sale in or towards payment of any debts owing by me or any charges on any of my said real estate which my residuary personal estate shall be insufficient to satisfy and shall then apply the residue of the sale moneys or such part thereof as my said trustees shall deem expedient in or towards the maintenance education advancement in life of my said three sons or such of them as shall for the time being be under the age of twenty one years at such times in such manner and in such proportions as my said trustees shall deem expedient.
