Bermuda alias Somers Islands

In the name of God, Amen, I Nathaniel Tynes Senior of Devonshire Parish in these islands, shipwright, being now of perfect sound and dsiposing mind and memory and knowing the certainty of death but not the time thereof, do make and ordain this my last will and testament in manner and form following that is to say viz't...

Imprimis: I give and bequeath unto my beloved wife Mary Tynes the one third part of my real and personal estate for and during her natural life, and to have free egress and regress, thru out the same.

Item. I give and devise the other two thirds of my estate unto my six children namely Deborah Tynes, Elias Tynes, William Tynes, Aretia Tynes, Nathaniel Tynes, and Mary Tynes, to be equally divided between tham, first deducting whatever ballance may be due to me from any of my aforesaid children (as by my books will appear) out of their dividend part or share.

Item. It is also my will and desire that during the life of my said wife, my said children do possess and enjoy their thirds both of my real and personal estate before mentioned and that my executors herein mentioned at the death of my said wife, do make an equal division of the whole of my said houses and all my land, which I give and devise unto my said six children, or the survivors of them, and to their and each and every their heirs and assigns, upon an equal division. But if my said children should disagree in the partition thereof, I do hereby impower my said executors, to sell such parts, of my said houses and land of those disagreeing, unto others of my said children, not forgetting to discount whatever may be due to me as aforesaid.

Lastly. I do hereby nominate and appoint my two friends Francis Jones Esquire and John Trimingham Esq'r executors of this my last will and testament and none other having revoked all former wills heretofore by me made and desire my executors to act according to my will intent and meaning herein. In witness whereof I have hereunto set my hand and seal the fifth day of September in the year of our Lord one thousand seven hundred and eighty six.

By His Excellency William Browne Esquire, Governor and Ordinary of these Islands.

I do certify that this 10th day of October 1787 before me the Governor personally appeared Mr Richard Gilbert Dill and Mr John Harriott two of the subscribing witnesses to within written instrument and solemnly made oath on the holy Evangelists of Almighty God, that they saw Mr Nathaniel Tynes (the testator) sign seal and duly execute the same as and for his last will and testament and that at the time of such execution the said testator was of sound and disposing mind, memory, and understanding to the best of their respective judgements, and that they also saw James Love Dill subscribe his name as witness thereto.

In testimony whereof I the Governor aforesaid have hereunto set my hand and seal at arms the day and year above written.
