Will of SOLOMON JOELL of Pembroke Tribe Senior Nov 13 1763

Who is now weak & sick but have reasonable sense & memory blessed be God. To wife MARTHA during her widowhood only two houses where I now dwell together with 1/2 share land running from the path to the southward of said houses to the part butting on land of Mrs ANN WATERMAN & at wife’s decease or remarriage same to son SOLOMON....Youngest daughters FRANCES & ESTHER JOELL house & 2 acres that I lately purchased from LEWIS JOHNSTONE & [?] now in possession of Mrs RUTH PITT.....[?]

Son SOLOMON a lot at the waterside 52 feet long e to w & in breath from the waters edge to the path above it where I have made the beginning of a wharf (perhaps where "Scarborough" is today, 1934, on Pitts Bay Road) The remaining part of the land below the path at the waterside to my daughs & their heirs viz:

to be equally divided into 8 lots, the eldest to have 1st choice & so on to the youngest & the children are not at liberty to sell but to my children, grandchildren or great grandchildren unless there should be but one child or grandchild left & then he or she may sell to whom he or she pleaseth.

My will is that there should be a good well built house erected & finished on the lot given to my son SOLOMON as soon as convenient. Said house to be 52 feet long east & west; 36 feet North & South; 2 stories high; 5 rooms upon each floor & a cellar under each room; a sufficient number of windows & doors as may be sufficient to make it a very handsome uniform house to be worth by the veracity of 5 men not less than L500 current money of Bermuda when finished which house I desire the use thereof to my wife & all my children for 9 years from the day of my decease & at that time said house to be given unto the possession of son SOLOMON; I mean the whole especial charge of the aforesaid house shall be taken from my personal estate before any division be made of my estate either real or personal.

The personal to continue in possession of wife MARTHA the full term on 9 years from the date hereof except any of my daughs should marry before the expiration of 9 yrs, if so she is to have L115 & to be charged with same until there is a final division.

I particularly give to my wife MARTHA after the expiration of 9 yrs the best negro man, my girl ROSILLA, my best horse, side saddle, the best bed, bedstead & furniture & the best chest that is now in my possessin likewise the 1/8 pt of my personal estate after all my debts are discharged.

To son SOLOMON my negro man BILLY; my biggest silver tankard & 6 silver spoons marked S.J.; my watch, sword & all my wearing clothes to be delivered to him at the expiration of 9 years or sooner if Excrs like to do so.

My will is that my son SOLOMON may be taught to read & write, understand arithmetic properly Navigation, Dancing, the use of the small sword properly & be kept at the best Latin Grammer School six years or more; if he likes to learn either in Bermuda or North America in order to learn that language as far as the time limited & his ability will admit of & the charges there of to be part of my estate personal before any division thereof. All children while unmarried to live with their mother at the expense of the estate for 9 years provided they live frugally & reasonably but if they are anyways disobliging or undutiful to their mother I leave her and to my excrs to use them as they deserve.

My will is that my part of the 4 vessels in which I am concerned may not be sold as long as they are of benefit to my estate.

If negro man JOHN misbehaves he is to be sold to the highest bidder.
