In the name of God, Amen, I Joseph Hinson of Smith's Parish not being in perfect health but of sound mind and memory and considering the uncertainty of human life do make and ordain this my last will and testament as follows:

I will and order that all my just debts be paid and after the discharge thereof I give and bequeath unto my loving wife Catharine Anne Hinson during her widowhood all my real and personal estate after condition that she my said wife shall therein maintain and provide for my daughter, Mary Jane Hinson during their lives or as long as my said daughter shall remain unmarried. An after the death of my said wife I give and bequeath all my estate real and personal to be equally divided between my two surviving children, John Wood Hinson and Mary Jane Hinson and their heirs and assigns forever. Should either of my said children die without lawful issue before there is a lawful division of my estate then in such case such child's part be for the benefit of the survivor.

It is my will and desire that if my wife should remarry that my personal estate be inventoried and appraised according to law- one third part thereof I give and bequeath unto my loving wife aforesaid, the other two shares of such personal estate together with the whole of my real estate I give and devise to my said surviving children and their heirs and assigns forever upon an equal division each alike. but if either of the said children should die leaving issue, it is my will that the issue of such children should have the part such child would have been entitled to if living.

And I do hereby nominate and appoint my dear and loving wife Catharine Anna Hinson executrix and Mr Giles Spencer Musson and Mr William I Trott executors to this my last will and testament hereby voiding all former will or wills by me heretofor made.

In witness whereof I have hereunto set my hand and seal this twenty seventh day of April one thousand eight hundred and forty three.

I hereby certify that on the twentyfourth day of September in the year one thousand sight hundred and seventy before me the adminstrator and ordinary aforesaid personally appeared Richard E Eve one of the subscribing witnesses to the annexed instrument of writing purporting to be the last will and testament of Joseph Hinson late of Smith's Parish in these islands, deceased and dated the twenty seventh day of April 1843, who solemnly made oath on the Holy Evangelists of Almighty God that he saw the said Joseph Hinson sign, seal and duly execute the same as his last will and testament and that at the time of such execution the testator was of sound and disposing mind, memory, and understanding to the best of this deponent's judgement, that he also saw John W Foggo (since deceased) and Edward R Eve subscribe their names as witnesses thereto and that the said John W Foggo and Edward R Eve were present during such execution at the same time with him the deponent.
