Composite Volumes 1739-1746, 1743-1747 (reel 594) (Bermuda archives)
22 December 1762

Bermuda alias Somer Islands

By his Excellency William Popple Esquire, Governor, Commander in Chief and Vice ASdmirall of these Islands

To whom this present writing or instrument of protest shall come or may concern Greeting

Know ye that this twenty second day of December 1762 before me personally appeared John Goodwin master of a certain sloop called the Charming Nancy now lying at anchor in the harbour of Saint George and solemnly made oath on the Holy Evangelists of Almighty God, that on the 19th of this instant being cleared for his departure from these islands and being then ready to proceed on his voyage for Virginia or Maryland he this appearer applyed to William Adams a pilot at the east end of these islands to go on board his said sloop in order to conduct said sloop out to sea who replyed he could not by any means take charge of said sloop until further orders, and on the 20th following he this appearer applyed to one Richard Minors also a pilot to conduct his said sloop out to sea who did go on board and caused the said sloop to be put under sail, but soon after he the said Minors received a messuage and refused conducting said sloop to sea and ordered to anchor again, and on the 21st following he this appearer received an order from the Governor and Council of these islands reference thereto may fully appear whereby this appearer was obliged to take on board his said sloop sundry Provincial troops in order to transport them to such port as he was bound for. And in like manner also appeared John Cox mate and Jonathan Stone a mariner of and belonging to the said sloop who likewise solemnly declared that all what the above John Goodwin hath before deposed is true. Wherefore the said John Goodwin for himself his mariners and owners ffreighters and all others whom it doth or may concern does solemnly protest against the matters aforesaid and all damages which may hereafter be sustained thereby and also against all costs, delays, disappointments, expences, and other matters which may be lawfully protested against in as large and ample manner as the same can or may be done by law or form, and persevering in the said protest the said appearers have hereinto set their hands the day and year first above written.
John Goodwin
John Cox
Jonathan Stone

This done and protested before me the Governor and Vice Admiral aforesaid. In testimony whereof I have hereunto set my hand and caused the publick seal of these islands to be affixed the day and year first before written.
