ALBUOY, BERNARD
W12a:35
12 December 1779
In the name of God, Amen, I Bernard Albuoy of the islands of Bermuda in the Parish of Smith's being weak in body but of sound and perfect mind and memory (blessed be God) do this 12th day of December in the year of our Lord 1779, make and publish this my last will and testament in manner following...
My will is that all my past debts, with my funeral charges be paid, before any division be made in my estate after my decease.
I give and bequeath unto my loving wife Margaret Albuoy to her use for her life, or as she remains my widow, my Negros Ben the carpenter with Negro boy Sam, Tom Sawyer, Scorpio and Montellyou with all their tools for the use of their business, as also that Negro wench she shall choose out of my estate with the furniture now belonging to me in my said house or such as I may be possessed of with before I die, as well as all vessels or parts of vessels, boat or boats, afloat or on the stocks belonging to one.
After the decease of my wife my will is that no division be made of the before mentioned Negroes neither in household furniture, until my children unmarried be made up equal with those already married, then that an equal division be made among all my dear children, remembering it as not my design that any of the before mentioned Negroes or furniture be disposed of until my wife's decease, unless great want should oblige my wife to do so.
My will is that after my decease, my son Leonard possess and enjoy the nine acres of land at Tucker's Town as fully and clearly as I myself may or could have done in my lifetime by a grant bearing date of 23rd of October 1759 now in my desk.
My will is that after my decease it is to be understood by everyone of my dear children, that my deed of writing or otherwise given by me to any of them for any part of my estate whatsoever. that such part or parts of my estate so given, be such parts received of his heirs or their proportion of my estate, as the division before mentioned might give.
My will is that my grand daughters Ann Gilbert and Mary Spencer Albuoy to share equal with one of my dear children as in a manner aforesaid.
I make and ordain my loving wife executrix of this my will, and my son Leonard Albuoy executor thereof, to take care and see the same performed according to my true intent and meaning at the same time take advice of my son in law Thomas Moland if thought proper.
In witness whereof I, the said Bernard Albuoy have to this my last will and testament set my hand and seal, the day and year aforewritten.

Signed, sealed, established and declared by the said Bernard Albuoy the testator as and for his last will and testament in the presence of us, who were present at the signing and sealing thereof....
