Minutes of HM Council: 13 August 1686

At a Councell table held at St Georges on Friday ye 13th Augt. 1686.

John Stone sworne to ye sixth article prefered by Wm Milbourne & Willm Righton, Senr agt ye Rt Honble Richard Cony, Gover declared he knew nothing of ye matter.

Mr Samll Trott sworne, saith he hath heard Stone talke yt he hath caused the said article to be exhibited.

Willm Righton, Senr and Samll Trott sworne to some papers under their hands refering to Mr Richard Staffords incouraging & hasting ye proceedings agt ye Rt Honble ye Gover before he had received his Maties letter, only upon a copy of a copy, signed by one Burghill, ye said Trott owned his hand, the said Righton said, it looked like his hand but he did not remember it.

Madam Walker sworne that Mr Geo Turfry protested to ye Governe yt he would not carry any pson off these islands without a tickett, and that Mr Samll Trott desired ye Rt Honble ye Gover to grant a posse comitatis to stop ye sd Trufry when ye sd Turfry's vessel was under saile.

Mr Arthur Jones sworne said yt he remembers nothing of any articles preferd by Willm Righton, Senr agt Henry Durham either to ye Assembly or Councell.

Mr Richard Phillips, Capt Barth Sharp & Mr Anthony Joyner sworne viz: whether they have ever formerly been of ye Rt Honble ye Governe Councell; doe all declare ye contrary- John jauncye, Dept Sect. sworne attest ye same.

Memornad. That on Tuesday ye 3rd of Augt 1686 it was moved in Councell by William Righton Senr yt he was not in a readiness to prove his articles agt ye Gover there having not been sufficient publication made of His Maties letter according to ye tenour of ye same, oredered by ye Councell ye His Maties letter to be published in all churches on Sunday next. Which publication was made accordingly.

On Monday ye 9th at a Councell then held Willm Righton Senr was again called to prove his articles agt ye Govere he alleged yt ye Govere ought to prove his complaint first he being first named in His Maties letter, which being put to vote was allowed of by ye Councell.

On Tuesday ye 10th Augt Willm Righton Senr being called to prove his articles alleged yt he was not capacitated so to doe for want of warrants to summon his evidences, and often did move ye Govere to grant ye same but he thinking it irrational for any man to grant warrants to summon evidences agt himself, it was refused, he then moved ye Councell yt they would issue out their warrants for ye same effect. But they (nemine contra dicente) did declare that his Maties letters being published at large it was sufficient warning and they would grant noe other.
