Minutes of HM Council: 3 May 1697

At a council table holden at the Sessions House on Monday the third day of May 1697. Present:

His Excellency John Goddard Esq Governor Capt Gilbert Nelson Capt Richard Peniston Samuell Spofferth Esq
Coll. William Peniston Capt John Tucker Capt Wm Outerbridge  

On a motion made by his Excellency the Governor about calling an Assembly It is advised that an Assembly bee forthwith called and that His Excellency be pleased to issue out his writts accordingly.

Ordered that Mr John Kendall minister of St Georges bee paid twelve pounds & tenne shillings for half a yeare's sallary due the 18th january last.

Ordered that Capt John Tucker doe pay unto Capn Ganl Johnson the summe of seaven pounds towards his charge att the Queens ffort.

That the petition of Nathaniel Smith &c, soldiers at the Castle bee referred to Capn John Tucker & Capn Stephen Crow.

Ordered that Capt John Tucker pay unto Capt Wm Jones the summe of three pounds thirteen shillings & seaven pence after viewe of the work done.

Ord. that Capt John Tucker doe pay unto Capt Gilbert Nelson the sum of thirty seaven pounds ten shillings being for thirty pounds sterl. paid in England to Mr Nicholas Trott the late Agent of Bermuda.

Ord. that Mr Secry Trott give in his perticular account of his disbursem.ts on the publick account of his agency in England and also of the powder money received by him dureing his being Secretary of these Islands.

On hearing the petition of Thomas Fforster and Kesiah his wife about the altering and amending the Order of Court of the 9th day of November last past made on the cause there depending betweene the said petitioners and William Wilkinson, Robert White, and Sarah his wife about the two southside shares of land in pagitts Tribe heretofore the land of Patrick Copeland decd And upon hearing the arguments about the same.

Itt is thereupon the opinion of this Court directing the sheriffe or Provost Marshall of these Islands That hee sumon twelve free and lawfull men of the Viceintude and Neighborhood in the said Tribe and takeing them with him that hee in his proper person goe to the said two shares of land and the messuages and houses thereunto belonging And thereby the oaths of the said twelve in the premises (the parties aforesaid to bee by the said sheriffe preadvised if they will be present) To make or cause to be made partition betweene the said parties of the aforesaid two shares of land and premises so that one full and equall moiety thereof now undivided when divided may bee assigned allotted and allowed to the said Thomas Fforster and Kesiah his wife ffor their part to bee held in severalty by themselves And that after such assignment and allottment made of the said moiety an entry may bee thereon had and possession thereof delivered unto the said Thomas and Kesiah according as this Court shall direct in Justice and equity. And that the said William Wilkinson, Robert White and Sarah his wife pay costs of the Court of the ninth November last according to the order of the same.
