Minutes of HM Council: 9 October 1740

Att a Councill holden at the House of his Excellcy the Govr by adjournment on Thursday the 9th day of October 1740.
Present:

His Excellcy Alured Popple Esq Gov Andrew Auchinleck, Esq Saml Burrows, Esq William Riddell, Esq
Generall Jones Leonard White, Esq Nathl Bascome, Esq General Butterfield

Three membrs of the House of Assembly attending present to the Councill a message in the words following:-

Vizt. That their house desired the Councill would appoint a committee of their house to inspect the platform in St Georges. Whereupon his Excellcy sent a message in the words following. Vizt that he did yesterday appoint a committee of the Councill to meet a committee of their house to be appointed to inspect the platform in St Georges and that he should have acquainted the house thereof but that the auction of Capt John Sands (Lands?) estate prevented it. The Honoble Genll Butterfield Treasurer was this day sworn to his Publick Accnts in which the sum of two hundred and seventy pounds fifteen shillings and sixpence farthing remained due to him from the country.

His Excellcys sent by the Secretary Mrs Eliza. Musson's petition to the House of Assembly with the following message vizt. The Govr having received this petition from Mrs Musson of Hamilton Tribe directed to himself the Councill and the Genll Assembly has ordered  me to desire you will consider the same and return the petition to him with the opinion of the house thereon.

The Committee appointed for inspecting the Platform in St Georges makes their return as follows, vizt. ... October 9th 1740   Bermuda   At a meeting of a committee of both houses this day appointed by desire of his Excellency for the inspecting of the platform in St Georges.  

Esqrs. of the Councill: Gennll Butterfield, Samll Spofferth, Nathl Bascome.                                      

Esqrs of the Assembly: Capt Stephen Judkin, Capt Samll Burt, Capt Benj Harvey                               

The committee finding the said platform much decayed do hmbly desire that his Excellency would be pleased to order and direct the repairation thereof in such manner as he shll think most proper.             S Smith, Clk of the Committee

To his Excellency Alured Popple Esqr, Govr Commander in Chief

Mr Speaker and the whole House attending present his Excellency in Councill their answer to his letter of the 7th instant in the words following vizt:

To His Excellency the Govr etc.

Mr Speaker at the same time spoke to his Excellency in manner as follows. Vizt. I am desired by the House to acquaint your Excellency that they will appoint a Committee to consider your Excellency's proposals concerning the Officers and Public Records and to make their report to our next sitting as also that the House will then give final answer to your Excellency's speech concerning the current coin.

After the delivery of which answer and speech to his Excellency Mr Speaker with the severall members then present withdrew and returned.

Three members attending present to the Councill the results of the Committee relating to the inspection of the platform approv'd of by their house for their approbation which was accordingly approv'd by the Council.

Adourned to the afternoon.

Eodem Die. In the afternoon present the same members as in the forenoon. Three members of the House attending present to his Excellency the Governor and Councill the petition of Mrs Eliz. Musson with the opinion of their house thereon in the words following vizt:

Put to vote whether an answer be sent to his Excellency in relation to the petition of Mrs Eliza. Musson as follows.

In the opinion of this House that three members of this House do meet a Committee of the Council at such time and place as they think proper to consider the subject matter of the Petition sent down by his Excellency to this house and that they make the reports at the next sitting of this House.

Which vote being approved of by his Excellency and Councill Genll Jones, Samll Burrows and Samll Spofferth Esqrs. are appointed a committee of the Councill to meet a Committee of the Assembly on saturday come sevenight at Mrs Mussons by one of the clock afternoon relating to her said petition.

The members of the house attending present to the House Mr John Slaters bill for Clkship of the Assembly to teh 4th October 1740 amt to teh sum of L21.4.0 passed by their House for the approbation of the Councill who at the same time delivered to his Excellency the Governor a message in the words following vizt. The House prays your Excellency to grant a writt for choosing a representative for Southampton Tribe in the room of Mr Durham Hall who is intendee of these Islands and that your Excellency would adjourn the House to the first Tuesday in March next His Excellency answered the house shall have an answer directly.

His Excellency in Councill ordered George Tucker, Secretary to attend the House of Assembly and present thereto a letter in the words following vizt.

To the Genll Assembly of Bermuda

Gentlemen,

Rather than lose any time in expressing those sentiments of pleasure and satisfaction which I have conceived from the Generall Assembly of your address of this day's date. I waive making so particular answer as otherways I might have given and it may be you might expect.

I flatter myself I cannot be mistaken in the opinion I have formed of your address and that your words and heart keep equal pace wherein you desire that strict union of concord between all parts of the legislature may for the future subsist. If you could be but sensible how much I desire the same thing you would not have conceived me capable of what you have laid to my charge in the conclusion of your address for an aggravated mind or a mind susceptible of insinuation must imply so much weakness not to answer the trust his Majestie has been pleased to honour me with in my present station in order to avoid the many difficulties which different circumstances might occasion. the King has had the goodness to appoint my advisers countrymen of your own. Gentlemen whose ties in this place not to mention their dispositions for the Public Good must naturally engage their attention in that particular only. If therefore their own interests, the interest of their families, and the discharge of their duty are any ties, surely they are incapable of   aggravating my mind. Insinuating anything to your prejudice or giving me any advice contrary to teh interests of Bermuda. But in the prosecution thereof they may not likewise think their Rights struck at when the late uneasyness are laid to their charge for such their refusall. But that I may no longer keep open a wound I am endeavoring to heal, let me advise your own words that whatever differences have happened may be buried in oblivion and let me assure you that I can have no greater satisfaction in this place than seeing you a happy people.

Then Samll Smith Clk. of the Board was ordered to attend the House and present thereto the return of the Committee for the inspection of the platform apporved by the Councill with the message following vizt. That a Committee of the Councill was appointed to meet a Committee of their house on Saturday come sevenight by one o'clock in the afternoon at Mrs Mussons relating to her petition.

Mr Slaters Bill for clkship amounting to the sum of L21.4.6. passed and allowed.

His Excellency ordered Geo Tucker Secretary to attend the Assembly and deliver the message following vizt. that the Governor adjournd the house until the first Tueesday in March next.
