Minutes of HM Council: 21 September 1687

At a counsell held SeptE 21st present:

Mr William Greene Capt John Hubbard Mr Chales Walker Mr Joseph Stowe  

A copy of Mr John Tuckers letters patent was read as also Capt John Hubbards deputiship. Capt  Hubbard accepted of the place of Provost Marshall Genel. and promised to indemnifie Mr John Tucker and to give him one half of the land & perquisites and so was sworne. It is the Counsells opinion that the two shares of land for the Marshalls property belong to Capt Hubbard to doe therewith as he shall see fitt.

An Act to appoint the number of Assembly for the future read, An Act against Pirats & Privateers.

To regulate the Militia for the better security of these His Maties Islands & subjects, For raising two troops of horse to be in readiness in case of an invation or insurrection, An Act to establish Courts of Judicature concerning the Kings Armes and those able to buy armes. The Speaker urged the little significance of two troops or parties of horse and declared the judgement of the Assembly against it though the GovernE urged for it. As also against baptizing of Negroes notwithstanding the GovernE declared that he had shewn Capt Peniston (one that came with the Speaker) the clause of his instructions wherein His Maties comand was signified for their being brought over to the Christian faith.

By his Excelty Sr Robert Robinson Knt GovernE and Capt Genr of the Castle Fortes, Militia and all His Maties subierts in ye Somers Islands als Bermudas and Vice Admirall of these Seas.

To Captian Thomas Richards, Chief Justice; Captain William Peniston, Mr Arthur Jones, Mr John Jansey, & Mr Joseph Darrell, Assistants.

Know ye that upon special considerations thereunto, moving doe by and with the advise of my Counsell and by virtue of a Comition under the Great Seale of England unto me directed & granted bearing date the 9th Sept 1686 of Whitehall from his most sacred Maties. James ye second by ye grace of God of England Scotland, Frances, & Ireland, King Defender of the faith &c constitute and erect a Court in the nature of a Countey Court and doe hereby appoint Capt Thomas Richards, Chief Justice of the said Court and also for his assistance Captain William Peniston, Mr Arthur Jones, Mr John Jansey, and Mr Joseph Darrell to meet and seat at such pleasure as you shall think fitt for ye space of tenn dayes comensing the 30th of this instant SeptE for the trying by a Jury and determining all manner of personall Actions to be brought befoer them between partie & partie when the Debt or debts doth ot exceed forty shillings. And they or any three of them shall have full power to set downe such orders & proceedings to be observed in this Court as they shall find to stand with Right Justise and a good Consciens, as also to issue out warrants for the summoning all & every person or persons as they shall thinke fitt and to constitute a Bayley to execute the process of the Court as aforesaid Chief Justice & assistance see cause to give Judgmt and grant execution thereupon given under my hand & publique seale of these islands at St Georges this 12th day of SeptE 1687.

Know ye that upon speciall consideracion me thereunto moving by & with the advise of my consell and by vertue of Letters Pattents under the Great Seale of England unto me directed & granted from his Sacred Matie James the Second by the grace of God of England, Scotland, France & Ireland, King Defender of ye faith &c doe constitute and appoint a Court of Oier & Terminer and I doe hereby appoint Capt Thomas Richards,, Chief Justice of ye said Court and also for his assistance Capt William Peniston, Mr Arthur Jones, Mr Johnn Jansey, & Mr Joseph Darrell to meet and sett at the Sessions House in St Georges upon Thursday the two and twentieth day of this instant September to inquire into here and trie by a Grand Jury and pettie Jury all causes to be done all manner of Justices & equity as farr forth as they are capable to pass sentence of death or otherwise acquit the Prisoner according to law & Justice given under my hand & Publique Seale of these Islands at St Georges this 12th day of September 1687.
