Minutes of HM Council: 16 June 1687

At a Councell held at St Georges June the 16th 1687.

Those present:

The persons chosen in each Tribe by vertue of the GovernE writ to be assemblymen are as followeth.

The oaths of allegiance and ___ was given and taken by all the persons aforesaid chosen to be of the Assembly except Mr Richard Stafford and Capt Edward Johnston who were then absent. Upon which they withdrew and in a short time returned and made report that they had made choyse of Capt Thomas Richards to be their Speaker of which said choyse and person the Governoe & Counsell did well approve of.

The Assembly by Capt John Hubbard made application to the Governor & Counsell for a new election of Assemblymen in St Georges, the former not being legally chosen, upon which the Governor issued out  his writ to the Deputy sheriff legally to elect and choose four men in St Georges Parish.

Tuesday the 7th of June (87), the Counsell being sitting, the Deputy Sheriff announced to the GoverE. Writ returned the persons following chosen in St Georges Parish to be Assemblymen viz. Capt Jonathan Stoakes, Mr Anthony Jenour, Mr Daniel Tucker, Lieut. Boas Sharp.

Mr Richard Stafford being returned a person legally chosen to serve an Assemblyman for Hamilton Tribe for his contemptuously refusing to serve his Maties, and Country according to election The Governor thought fit and did call in and vacate his Comision as Attorney GenrE. Upon Mr Richard Stafford condescending he and Lieut. Boas Sharp took the oath of allegiance and Sovrjay and were admitted membes of the Assembly.

Upon Samuel Harvey petitioning the Governor & Counsell to be released from his sureties from their Bond to appeare at the next Assizes, bound by the late Gov Col Coney for taking a negro from one of his Maties Servants in Elutheria, Hs Hone. and Counsell making diligent inquiry therein finding the bond to be entered from him, The negroe being returned to the parties consernd and now complaint made, they thought good to grant the petition.

June the 8th (87). The Assembly humbly proposed to the Governor in Councell as followeth whether they may concern themselves with the publique landa. The Governor answer that they may imploy for ye present the publique rents toward the defraying the public charges not to be  president.

Whether they may appoint a Treasurer for the receipt of money to be raised by the Assembly as to carrying on and management of the worke upon the fortifications. That they may appoint persons for receipt of money management of ye work and that one of them chosen out of ye Counsell.

The 10th day of June 1687. The Assembly made a request to ye GovernE & Counsell that three of the Counsell viz. Mr Lawrence Dill, Mr Thomas Outerbridge and Mr Richard Peniston might go with some of the Assembly to view the Castle and ffortes for the better ordering of the reparations thereof which was granted.

The Governor & Counsell being sitting severall members of the Assembly presented the Courts the following Acts viz.

1)An Act against cutting downe small trees.

2) An Act against taking boats from their moorings.

3) An Act for granting negroes trading.

4) An Act for punishing negroes for going out of their masters houses in the night time.

5) An Act for the repairing the bridge.

6) An Act for the amendment of the highwaies.

7) An Act for satisfaction of creditors.

8) An Act for putting out apprentices.

9) An Act for the payment of Assemblymen.

10) An Act for paument of jurors.

11) An Act for any coming into a parish being poor.

12) That no man shall be without a jury.

13) What warning shall be given for tenants at will.

14) An Act for the tryall of negroes.

15) An Act for  entering actions, pleading, etc.

16) An Act against destroying buttonwood.

17) Against wandering over mens grounds etc.

18) An Act for regulating office fees.

19) An Act for making all bonds voyd for returning vessels.

20) An Act for the book of Acts to be kept in each tribe.

21) Against destroying palmeto trees upon publique lands.

22) An Act for setling the ffortes and castles.

23) An Act for the Secretie refusing coppies of _____.

24) An Act for establishing Spanish coyne.

25) An Act for touching impositions laid on the subjects. Boas Sharpe offer touching Smith Ffort, severall of said Acts past and some returned to be amended.
