Minutes of HM Council: 4- 5 April 1728

Att a Council holden at the house of Mrs Eliza. Peniston widow at the Flatts on Thursday the fourth of April 1728.

Three of the members, Capt Saml Spofferth, Mr John Cox, Coll. Charles Walker waited on the president and Council to acquaint them of their meeting and to desire Dedimus for the Qualifying some new members; which dedimus was sent by Saml Smith Clk direct to Perrient trott Esq, Speaker, Leond White Junr Esq and Samuel Smith Secretary.

Upon reading the petitions of the Rev Andrew Auchinleck and Wm Swift relating to their salary.

Ordered that Maj Nath Butterfield Treasurer pay the said Auchinleck and Swift persuant to the prayer of their said petition out of the Public Money.

Adjourned to the afternoon.

Five members of the Assembly waited on the President and Councill and presented as petition of their houses for Coll. Richard Jennings refunding of the one hundred pounds, and that the sum of eighty three pounds or thereabouts (levit from the powder office) be likewise refunded for the use of the fortifications agreed that a committee of the Assembly meet five members of this Board about the said affair; they met accordingly:

It is the unanimous opinion of the Committee that the money mentioned in a vote of the house this day laid before the Council, is to be (if not already) appropriated to its proper use as usual, and that the Publick Treasury is accountable for the same to the Powder Office when demanded. As to Coll Richard Jennings" refunding the hundred pounds mentioned in the aforesaid vote; the President directs that he will not interfere therewith.

Then was referr'd the proceedings of the Gent rel to Mr Davenport's estate, pursuant to an order of this board of the 4th March last and read.

Ordered that the said proceedings so returned, be laid aside till the next taxation of Publick bills.

Upon reading the petition of Sam Newman, a tenant on the King's land in Tucker's Town.

Ordered that the overseer of the sd lands or either of them do admitt of and oversee Samuel Newman in cutting as many rafters and joice as may be required for erecting a house on that part of the land that Capt. Edwd North lately held from any part of the King's lands thereabouts.

The three of the members of the Assembly waited on the President & Council and presented an act of Assembly entitled an Act for raising a sum of money necessary for the repairing of the Castle and other fortifications of these islands for concurrance.

Adjourned the next day at nine of the clock in the morning.
Friday the fifth of April mett acording to adjournment.

Upon reading an Act entitled an Act for vessels paying powder money.

Ordered that the Secretary for the time being may oblige every master or owner of vessels belonging to these islands to give a true account of the tonage of his or their vessell or vessells, and that he receive powder or money for the same persuant to the said act, and in case of his or their refusall to make oath as aforesaid to stop his or their clearing till such time as they comply.

It is unanimously agreed by this Committee that the Treaasurer of the Liquor Tax pay into the hands of Leond White Junr Esq (who is appointed to manage and oversee the repairs of the Govrs House & cistern) the sum of twenty pounds out of the first money collected whereby he may prepare necessarys for his speedy proceedings therein, and that the said White brings his accounts of the charge in order to be passd as usual as soon as finished.

Ordered that publication be made that on the first Tuesday in May next the Court of Chancery will be held at this house.

In the afternoon, present, the same as in the forenoon.

Three members of the House waited on the President and Council and presented an Act intituled an Act for raising a sum of money necessary for the repairing the Castle and other fortifications of these Islands, for their concurrance, which was accordingly concurrd too, and at the same time presented the return of the Committee which was appointed to agree with some persons to compleat the repairs of the Govrs Houses and cisterns, with a vote of the House thereon, for concurrance which was likewise concurrd too.

Mr Samuel Smith (by direction of the President & Council) waited on the House & delivered the above mentioned Act & return with a message desiring Mr Speaker and the rest of the members would have the above act red publickly before the Assembly was adjourned which was accordingly done.

Ordered by this Board that a copy of the said be forthwith made out of each of the Justices throughout these Islands by the Clk of the Assembly.

A message from the House by three of the members acquainting the President and Council that they desired to adjourn to the first Monday in October next to which this Board concurred.
