Minutes of HM Council: 4 March 1727/8

Att a Council holden at the house of Mrs Eliz. Peniston widow at the Flatts on Monday the 4th day of March 1727/8.

Upon reading the representation of the overseers of the fortifications, relating to the same. It was ordered to be laid before the House of Assembly for their consideration, which accordingly was by Saml Smith.

Ordered that a commission be forthwith made out for Maj John Butterfield to be justice of the peace of Pembroke Tribe (in room of Joseph Stow Esq who is now absent who then took the usual oath accordingly).

Upon reading the petition of the Churchwardens of Warwick Tribe, ordered (for several reasons) that the same be referred to the next Council day for a hearing.

Upon reading the petition of Capt Henry Corbusier in relation to the salary of Mr William Nairn for whom he is attorney.

Ordered that Capt Richard Somersall and Mr Steph. Outerbridge church wardens of Hamilton Tribe forthwith pay into the hands of the said Henry Corbusier (the said Nairn's attorney) all the money that is or can be made appear to be due as his sallary in the said tribe.

Three of the members of the House of Assembly waited on the Honoble the President and Council and presented a bill of Mr Thomas Bostock's (their late clk) which had passed their house which was concurred in by the Board.

Present:
The same as in the forenoon except Capt Leond White.

Three more members of the Assembly waited on the President and Council and presented a vote of the House concerning the money reced by Robert Dinwiddie Esq as fines and amerciments accruing by vertue of the said Act be paid intyo the hands of the overseers of the fortifications and appropriated according to the express words of the said vote; the vote return'd.

Upon reading the representation of Maj Waller Mitchell, Robt Dinwiddie Esq and Mrs Frances Tucker widow relating to the estate of George Davenport Esq dec'd.

Prderd the Coll. John Jennings, Coll. Richard Jennings, and Lt Col Francis Jones (members of the Council) Maj Nathaniel Butterfield & Mr Nath Bascome (members of the Genl Assembly) do inspect into the merrits of the Bill presented to this Board by the said Mitchell, Dinwiddie, and Tucker and make a return of what they shall judge reasonable to be allow'd of the said Bill on the next Council day; and that the Attorney Generall attend them wheresoever they are pleased to meet.

Then the three members of the Assembly waited on the President and Council and presented a vote of the house concerning Maj Perient Trott"s supplying the country with timber for the making of wheels and carriages for the Great Guns at the fortifications; upon which a message was sent to the House desiring they would appoint a committee of three, to meet three of this board in relat to the said votes who were Capt. John Jennings, Coll. Richard Jennings and Andrew Auchinleck Esq and they met accordingly three of the members of the Assembly (to say) Maj Nath Butterfield, Capt Samuel Spofferth, and Leonard White Junr Esq who agreeing to the said vote was concurrd to.

Ordered that the balance of Maj Nath Butterfield (Treasurer) his accots. relating to the money raised for the repairs of the fortifications be paid to the overseers thereof or either of them as soon as apply'd for and that Robt Dinwiddie Esq pay likewise into the hands of the said Overseers all the money that shall be found (by his accnts) due to the country as theirs by vertue of the Platt Act.

A message was sent from the house of Assembly acquainting the President and Council that they desired to adjourn to such time & place as they should appoint, to which the Board consented to be on the first Thursday in Aprill which will be the fourth of the said month, at his house.
