Minutes of HM Council: 8 August 1739

At a council held by adjournment at the house of His Excellency the Governor on Wednesday the 8th day of August 1739.

His Excellency the Governor sent a message to the House of Assembly that Mr Speaker and the whole house should immediately attend him at Council, which message being delivered Mr Speaker and the House accordingly attended to whom his Excellency in Conicl presented an estimate of the present state of the Country and desired their serious consideration thereof upon which they returned to their house.

A message was sent from the House by three members thereof desiring that this Board would be pleased to appoint a committee to meet a committee of their house at the house of Mr John Slater in order to hold a conference on a compaint this day made to their house against Phillip, a Negro slave man belonging to the Reverend Joseph Horton, which being granted and Col. Nathaniel Butterfield, Nathaniel Bascome, and John Harvey Esq. were accordingly appointed a committee of this Board for that purpose.

It is the unanimous opinion of this joint committee that the house of Assembly address His Excellency the Governor for the grant of his warrant directed tot he Provost Marshall General or his deputy to take the body of the said Negroman Phillip into close custody and the same convey to His Majesty's Gaol in St Georges there to remain till such time as he sahll be thence delivered by due course of law.

Three members of the House attending this Board present thereto a vote of their house for addressing his Excellency the Governor in manner above is mentioned for concurrence which was accordingly concurr'd and returned.

This day his Excellency (with the advice of Council) signed two orders directed to the Honoble Nathaniel Butterfield Esq Treasurer for paying to Mr John Roberts the sum of ten pounds twelve shillings and fourpence curnt money as being the amount of two bills vizt. one for guarding and performing the office of a Oyer at the Court of Assize for the year 1738 L5.6.8 and the other for his services as Cryer at the Court of Qr Sessions amounting May 3rd last to the sum of L5.5.8.

The Governor sent a message to the house to acquaint them that he desires they appoint a committee of their house to meet a committee of the Board tomorrow morning to view and inspect the repairs lately made to Smith's Fort and to return their report of such views on inspection under their respective hands to his Excellency the Governor. The committee of this Board appointed for the above purpose are as follows:

Andrew Auchinleck, Saml. Burrows, and Nath. Bascome Esqrs are now appointed a committee for auditing the Publick accnts. of the Honoble Nathl. Butterfiled Esq Treasurer tomorrow morning at such place as they shall so cause to appoint.
