Minutes of HM Council: Monday 6 August 1694

Att a Court of Chancery held at the Sessions house in St Georges on Monday the sixth day of Augt. In the sixth year of their Majesties raigne King William and Queen Mary over England Etc. Anno Dom 1694.

Bee it remembered that now here this day appeares Daniel Tucker and Christian his wife Executrix of the last will and testament of Thomas Dunscombe her late husband decd and Richard Pitt Esq Executor of the last will aforesaid on behalf of Anne Dunscombe an infant sole daughter and heire of the said Thomas Dunscombe decd. And exhibits one bill of complaint against Thomas Dunscombe son of Philip Dunscombe deceased   About a share of land in Pembroak Tribe- And that now also appears the said Thomas Dunscombe the Deft abd Exhibits his answer to the same bill.

Now upon hearing the said bill and answer and the debate and agruments of both the said parties Thereupon it is by this court ADJUDGED and decreed That the revertion and inheritance of the share of land in question belongs unto the said Thomas Dunscombe the Dft hee apparing to this Court to be the heire att law to the same But by the devise of Thomas Jadwyn, Citizen and Cutler of London in his last will It is adjudged That the complts. upon the consideretion in the said will menconed do enjoy the said premises for the remainder of the term of years in the said Devise menconed in the siad will And that the said Thomas Dunscombe the Dft do deliver the quiet possession accordingly by unto the Complts. Also decreed that the charges of the court be equally paid between them Complts. and Dft.

An Appeale craved from the Judgement of this court by the Dft unto their Majities and Council in England. And granted.
