1960 LAST WILL AND TESTAMENT OF MICHAEL LINGNER (1899-1966)

To WHOM IT MAY CONCERN:

The undersigned executors of the estate of Michael Lingner, late of the Township of Aldborough in the County of Elgin, Province Or Ontario, who died on or about the eighteenth day of May, A.D. 1966, at the City of London, in the County of Middlesex, in the said Province of Ontario,

DO BY THESE PRESENTS, RELEASE, TRANSFER AND SET OVER, unto HANS THELLMAN, Seleus 218, Com. Danes, Raiom Sighisoara, Reg. Brasov, all right, title and interest of the said Michae1 Lingner, aforesaid, in any property in Romania and in or about the aforesaid vil1age or community.

IN HER MAJESTY’S SURROGATE COURT OF THE COUNTY OF ELGIN 


BE IT KNOWN that on the 25th day of October, 1966, the LAST WILL AND TESTAMENT of Michael Linger, last of the Township of Aldborough, in the County of Elgin, Retired Farmer, who died on or about the 18th of May 1966, at the City of London, in the County of Middlesex, and who at the time of his death had a fixed place of abode at the Township of Aldborough in the said County of Elgin, was proved and registered in the said Surrogate Court, a true copy of which said LAST WILL AND TESTAMENT is hereunto annexed, and that the administration of All and Singular the property of the said deceased and in any way concerning his Will was granted by the aforesaid Court to Gerhard Wiehle, (in the Will named Gerhardt Wiehle), of the Township of Aldborough, in the County of Elgin, Farmer, and Elizabeth Wiehle, of the Township of Aldborough, in the County of Elgin, Married Woman, the Executors named in the said Will they having been first sworn well and faithfully to administer the same by paying the just debts of the deceased and the legacies contained in his Will so far as they are thereunto bound by law and by distributing the residue (if any) of the property according to law and to exhibit under oath a true and perfect inventory of All and Singular the said property, and to render a just and full account of their Executorship when thereunto lawfully required.

WITNESS His Honour James Fenwich McMillan Judge of the said Surrogate Court at the City of St. Thomas, in the County of Elgin, the day and year first above written.

I, CHARLES IAN BLACK, a Notary Public in and for the County of Elgin, in the Province of Ontario, by royal authority duly appointed, residing at the Village of Rodney, in the County of Elgin, in the said Province do certify that the within or annexed paper writing is a Notorial copy of Letters Probate of the Last Will and Testament of Michael Lingner, late of the Township of Aldborough, in the County of Elgin, Retired Farmer, deceased, the said copy having been comparted by me with the original said Letters Probate, an act where of being requested I have granted under my Notorial form and seal of office to serve and avail as occasion shall or may require.

IN TESTIMONY WHEREOF I have hereunto subscribed my name and affixed my seal of office at the Village of Rodney in the County of Elgin, in the Province of Ontario, this 24th day of November, A.D. 1966.

THIS IS THE LAST WILL AND TESTAMENT

of me Michael Lingner of the Township of Aldborough in the County of Elgin and Province of Ontario made this twenty-fifth day of June in the year of Our Lord one thousand nine hundred and sixty

I Hereby Revoke all former Wills or other Testamentary Dispositions by me at any time heretofore made, and declare this only to be and contain my last Will and Testament.

I Direct that all my just debts and funeral and Testamentary expenses by paid and satisfied by my Executors hereinafter named as soon as conveniently may be after my decease.

I Devise and Bequeath the Real and Personal Estate of which I may die possessed, in the manner following, that is to say:-

I GIVE, DEVISE and BEQUEATH all of my property both real and personal and including all assets of any nature whatsoever to my daughter Elizabeth Wiehle and I direct that out of the said assets she shall pay to my son Michael Lingner the sum of Five Hundred Dollars per year for a period of ten years next following the date of my death, the first of such payments to be made within one year from the date of my death.

ALL the residue of my estate not hereinbefore disposed of I devise and bequeath unto

my daughter Elizabeth Wiehle.

AND I nominate and appoint my daughter Elizabeth Wiehle and my son in law

Gerhardt Wiehle

to be executors of this my Will.

IN WITNESS whereof I have hereunto set my hand the day and year first above written.
